Barber Goodman respects the intellectual property rights of others, and we expect the same in return. We take copyright complaints seriously and respond promptly to valid notices of alleged infringement submitted under the Digital Millennium Copyright Act (17 U.S.C. § 512, the “DMCA”).

This page explains how to notify us if you believe that content on https://www.barbergoodman.com/ infringes your copyright, and what happens after you do.

Before You File

Please consider the following before submitting a DMCA notice:

  • Make sure you own the work or are authorized to act for the owner. Only the copyright owner or their authorized agent may submit a takedown notice.
  • Consider whether the use is fair use. Brief quotations, commentary, criticism, and similar uses may be lawful even without permission. Courts have held that a copyright owner must consider fair use before sending a takedown notice.
  • A simple email may resolve it faster. If you’d prefer we simply add attribution or update a credit, reach out through our contact form – we’re happy to talk.

Warning: Under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees. Do not submit false claims.

How to Submit a DMCA Takedown Notice

To file a copyright infringement notice, fill out the form below. To be valid under the DMCA, your notice must include all of the following:

  1. Identification of the copyrighted work you claim has been infringed (or, if multiple works are covered by one notice, a representative list of those works).
  2. Identification of the allegedly infringing material, with enough information for us to locate it – the exact URL(s) on our Site where the material appears.
  3. Your contact information, including your full legal name, mailing address, telephone number, and email address.
  4. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner.
  6. Your physical or electronic signature.

Incomplete notices may not be actionable, and we may contact you to request the missing information before taking action.

What Happens Next

When we receive a valid DMCA notice, we will:

  1. Confirm receipt of your notice;
  2. Review the claim and, where appropriate, remove or disable access to the allegedly infringing material promptly; and
  3. Where applicable, notify the party responsible for the material and provide them with a copy of your notice.

Counter-Notification

If material you posted or that you are responsible for was removed in response to a DMCA notice and you believe the removal was a mistake or misidentification, you may submit a counter-notification to james@barbergoodman.com. A valid counter-notification must include:

  1. Identification of the material that was removed and the location (URL) where it appeared before removal;
  2. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  3. Your full legal name, mailing address, telephone number, and email address;
  4. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, the federal courts located in California), and that you will accept service of process from the person who filed the original DMCA notice or their agent; and
  5. Your physical or electronic signature.

Upon receipt of a valid counter-notification, we may restore the removed material in 10 to 14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the alleged infringement.

Repeat Infringers

We will terminate, in appropriate circumstances, the access of users or contributors who are determined to be repeat infringers.
